A1 Online Services Terms & Conditions

The following is a list of our basic terms and conditions of use, please read them carefully before taking out any products or services.
General Terms & Conditions
Set up Fees are payable one time only.
Monthly fees payable in advance, no cancellation fees or time restrictions.
Domain name costs are included in the setup fee but are renewable, yearly after at approximately Ł15 per year.
There are no other charges added.
Discounts are available to 6 monthly and 12 monthly customers.

TERMS OF SERVICE
A1 Online Services provides World Wide Web page hosting. A1 Online Services reserves the right to suspend or cancel a customer's access to any or all services provided by A1 Online Services when A1 Online Services decides that the account has been inappropriately used or otherwise.

SERVER USE
Personal accounts are to be used by the primary owner only. Personal account holders are not permitted resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

A1 Online Services reserves the right to refuse service and /or access to its servers to anyone.

A1 Online Services do not allow any of the following content to be stored on its servers:
Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content not legal in the geographical area of the webspace and any material in violation of any Federal, State or Local regulation.

Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

UNLIMITED USE POLICY
High bandwidth usage: A1 Online Services offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, A1 Online Services may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, A1 Online Services reserves the right to impose the High Resource User Policy for the consideration of all customers. Most accounts and packages have disk space, bandwidth and domain limits, these may be changed however in the case of free domains, they are "held" and owned by A1 Online Services and the client pays for use of said services rather than owning them. Bandwidth and disk space may be altered at any time in accordance with our terms and conditions, the client does not automatically own the rights to use a specific amount of webspace, domains or bandwidth. If any of these services are not used in a particular month then they cannot be transferred or carried on for use on the next months account. All usage policies are intended to be used with the account package subject to daily, weekly, monthly or yearly time limits and constraints.

HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor/memory utilization.

A1 Online Services may implement the following policy to its sole discretion:

When a website is found to be monopolising the resources available A1 Online Services reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby A1 Online Services continues hosting the website for an additional fee.

PAYMENT POLICIES
All accounts are set up on a prepay basis. Although A1 Online Services reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due every year, from the date the account was established. Customers will automatically be charged again at the end of their prepay period unless closure notification has already been given.

In situations where the card number on file is declined A1 Online Services will immediately suspend the facility to purchase services on-line until the outstanding charge is processed successfully. In addition, A1 Online Services reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made. At this point the customer's card will be charged automatically. If a hard copy is required there will be postage, packaging and administration fees charged.

All payment is in UK sterling.

You are required to have a valid credit/debit card or payment method registered on your account
at all times or an agreed account with A1 Online Services

PAYMENT OPTIONS
In order to streamline our accounting procedures and keep costs down A1 Online Services runs a limited number of payment options.

Credit / Debit Cards:
A1 Online Services accepts all Paypal accepted methods, cash and cheque payments

CANCELLATION AND REFUNDS
A1 Online Services reserves the right to cancel the service at any time.
If a customer contravenes A1 Online Services' terms of service a refund will not be issued in the event of a cancellation.
Fees charged on a prepay basis are non-refundable.
Once the initial trial period has expired customers are not entitled to receive a refund unless the service is cancelled by A1 Online Services.
In addition some accounts incur set-up fees, these charges are also non-refundable.
There is no Cancellation Fee.
There is no prior notification time restriction.

INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold A1 Online Services harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against A1 Online Services, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product or service sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless A1 Online Services against liabilities or blame arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with A1 Online Services' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement. (4) any defective products sold to customer from A1 Online Services' server. (5) any content, advertising, goods, products, services, sub contract work, task undertaken, jobs accepted and completed that fail to meet any laws, rules or regulations of any sort, taking into all considerations of location and content. (6) any illegal content unauthorised copyrighting, distributing or file sharing mp3's, including uploading and downloading or allowing access to shared folders containing unauthorised copyrighted material.

DISCLAIMER
A1 Online Services will not be responsible for any damages your business may suffer. A1 Online Services makes no warranties of any kind, expressed or implied for services we provide. A1 Online Services disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non deliveries, wrong delivery, and any and all service interruptions caused by A1 Online Services and its employees. A1 Online Services reserves the right to revise its policies at any time.
